Staying Compliant in a Changing Immigration Landscape

Regardless of your political beliefs, it is widely anticipated that organizations will experience stricter enforcement policies of their I-9 processes in 2025.

Records indicate that in 2017, there were 1,360 I-9 audits.  In 2018 that number increased dramatically, with ICE conducting nearly 6,000 audits.  It is our understanding that the number of audits would have grown significantly but the pandemic interrupted those plans.  We project there will be a large increase in worksite investigations and I-9 audits in 2025.  

Given this, employers are advised to:

• Conduct internal I-9 audits before January 20, 2025
• Ensure all I-9 forms are accurately completed and up-to-date
• Implement clear policies and procedures for I-9 compliance
• Provide thorough training to staff responsible for I-9 processing
• Consider seeking legal counsel or using specialized I-9 compliance software

Sectors such as agriculture, hospitality, construction, and manufacturing are expected to be key targets for scrutiny in 2025 and beyond. 

Fines for violations can range from $281 to $2,789 per I-9 form so be sure to start conducting audits quickly to avoid these costs and maintain your organization's reputation. 

Immigration is likely to remain a hot-button topic throughout 2025. By prioritizing I-9 compliance, you can safeguard your business from potential legal and financial risks.
